Illegal Block of Flats Construction

Background

A developer began constructing a block of flats in violation of zoning plan rules and other planning regulations.

Actions Undertaken

SCRA joined a court case against the developer and secured a stop order. SCRA also confirmed that the existing zoning plan remains legally in effect despite its expiry date, pending a replacement.

Progress Updates

  • 27 February 2024Case ongoing; SCRA is seeking demolition of the illegal construction.
  • 21 December 2023The Environment and Land Court at Kwale (ELC Case No. 12 of 2021) delivered judgement on parcel Kwale/Diani Beach/800 and 801: non-compliant units were ordered altered or demolished within 120 days to comply with zoning height limits and the 50% development coverage rule, with costs awarded against the defendant.
